>> why did you end up back here today? >> i don't know, man. >> arrested mcdonald on monday for allege itly assaulting a woman with a baby in her arms at an apartment that he owns and again yesterday for showing up at that apartment in violation of the restraining order a judge issued after monday's arrest. the only reason his client went back to that apartment was to let in his investigator to look at a possible broken door. the investigator did confirm the woman was away in santa cruz at the time and that mcdonald immediately left after police called him to let him know that she had returned and seen his car at the apartment complex. mcdonald was arrested later in the day at a sandwich shop. you might recall the 49ers caught mcdonald for a pattern of poor decision making. the chicago bears cut him earlier this week after his arrest on monday. reporting live here in san joesz, bob redell, "today in the bay." >> thank you, bob. it's 6:05. suspect with a long rap sheet is behind bars after going on a

wild crime spree. taking hostages and eventually surrendering and today we could learn his identity. this is police rushing in, guns drawn, as a man eventually surrounders. it started yesterday morning. police say the 35-year-old suspect stole a car in walnut creek. then carjacked a man at a business and led police on a wild chase. officers eventually used spike strips to stop him in antioch. he then ran to a nearby gas station where he took two tamgs but not before he terrified a few witnesses. >> he came to my car with a gun pointing it at me telling me to open my door. >> he pointed a gup at us and i started yelling get away and he turned around and tried to get into another car. tritd to get into another truck and then ran inside the store. >> hostage negotiators convinced a suspect to surrender. officers have yet to release his name because they say the investigation is on going. new video right now in a new round of storms slamming the southwest. oklahoma already submerged in water and this morning people

across that state are waking up to this. more heavy showers and lightning. meantime over in texas, a large tornado hit a dash drilling rig in the panhandle last night. that tornado touching down in the town of canadian. it also injured three people. rain and tornadoes have battered the region all week long killing at least 21 people in both states and 11 are still missing. that situation not going to get any better either with more storms forecast on the way. closer to home, sam, historic drought is forcing a popular fireworks show to fizzle out. the city of cupertino says it is canceling this year's show. the fireworks are usually launched from the baseball field at cuber tin no high school but the school says it has to spray more than 100,000 gallons of water on all of its sports fields ahead of time to prevent a potential fire. so the school district is shutting showdown. the city's other independence

day events will go on as planned. >> tough balance there. tradition of the fireworks. all right. any fireworks out there right now? nope. just more fog as we look live at san francisco this morning at 6:08 on your thursday morning. >> love moisture in the air out there. it would be tough to see them, i think, rob. >> pink and blue clouds right now around san francisco. low clouds hanging over the city by the bay right now as you can see some of our temperatures are in the mid 50s right now in san jose. 56 degrees currently in the south bay. there's another view of san francisco. 53, misty skies over towards oracle arena. drizzle drops there not just for the splash brothers but that's actual airport observation right now at oakland airport. they are reporting enough drizzle to wet the runways there at times around oakland this morning. 53 degrees. so 50s across the board. low clouds in the morning. in the afternoon, low clouds from mt. hamilton looking down. squished a little bit closer to ground level this morning. only 1,000 feet to 1500 feet thick.

we should get the clouds to bri break up a bit. sunshine, a few high clouds going by at times today. and then low clouds staying around the coast. not much warming around pacifica or half-moon bay or san francisco. san jose today low 70s. we'll see temperatures close to 60 in san francisco. low 70s around the north bay. and you will notice the numbers closing in on 80 degrees in pleasanton and livermore. and we will see 80s possible around parts of the south bay as we start the weekend saturday. the center of the screen. notice the temperatures warming up in the south bay. san francisco, mid 60s as we start the weekend. for the north bay, 80 on saturday. 83 around the tri-valley on saturday. increasing clouds and we're still going to leave in showers on sunday with cooler temperatures the main effect of that system though will once again be dropping our temperatures early next week. for another check of your morning commute, here's mike. >> we have low clouds rob is talking about. emeryville camera. turn toward the bay bridge tower. high enough that it's clear for the roadway. may be patches throughout the

a live look outside. san francisco shows you the low clouds over downtown. 50s for now. low 60s around san francisco for the afternoon and mid 70s closer to san jose. mike? >> we're looking over here toward the fremont area. headlights are heading down to san jose without any interruption. we're going to talk about slowing though a little farther north. that's coming up. all new this morning. silicon valley company paying big bucks to settal water pollution case.

according to the press democrat jdsu agreed to pay $92,000 in fines to the city of santa rosa. inspection revealed the company had been disposing of ammonium salt in the sewer system over several years. its facility in the north bay. the jdsu makes optical products and 3-d sensing devices. scott mcgrew has been talking about housing costs this week. >> if he's got any money left over, scott, he's on a roll now. back with more. good morning. >> back with more. sam, we talked about how expensive houses are. that was tuesday. then wednesday we looked at how many people were bailing out of the bay area for more affordable homes in places like seattle. today we're going to talk about the hidden costs of not buying a home. economist with realtor.com has run the figures to see how much it would cost you if you delayed buying a home in the country's hottest markets. now, economists call this opportunity costs. it's the cost of not doing

something. for instance, the potential bigger salary you would give up by not going to college. that's an opportunity cost. in this case, it's the cost of not buying and renting instead. so this economist, jonathan smoke, looked at the biggest opportunity cost. biggest is santa cruz. where waiting a year to buy will cost you nearly $66,000. costs like the house price goes up and interest rates rise. san jose, the cost of waiting is $61,000. san francisco, $60,000. the same study says owning a home in the city over the course of 30 years will give you gains of $279,000 above and beyond the value of the house itself. so when you sell you get your money back, plus a quarter million. do keep in mind while the numbers were put together by a legitimate economist, he does work for realtor.com which has every interest in buying you a house. chip maker of broad come turning

to business news, merging this morning in a deal worth $37 billion. the nasdaq hit new records as well. you know, kris sanchez, guys, was saying one of the babies looks like me. i'm trying to figure out. >> the one on the right. >> the one on the right. yes, that's not me. it's a big baby on the nyse although i do have that reputation. >> the big bluesy is what you have, scott, which we are all envious of. thank you. happening right now, investigators are taking a closer look at miser to use billion balls of goo that washed ashore on a stretch of southern california beach. those blobs were found along manhattan beach and they appear to be balls of either tar or oil. there's no word on whether the substance is connect nedney way to last week's massive oil spill near santa barbara. roughly 100 miles away. authorities say it could be a natural occurrence. the beach is closed right now until further notice. bay area marine experts say they think they know why so many dead whales are washing ashore

at northern california beaches. just yesterday a baby gray whale was discovered on the beach in point reyes. it's 12th dead whale to wash ashore from monterrey to fort bragg in the past couple of months. offshore winds would push whale carcasses out to sea but the winds are coming from a different direction pushing what's in the ocean now to the beaches. >> staggering number of whales in total. okay. time to check your microclimate forecast at 6:17. live look outside. downtown san jose. not quite as cloudy. some of the other camera angles we've seen this morning. >> that's right. >> some out there. a little bit of wind. you mentioned it, laura. wind speeds are picking up this morning. >> you're going to be watching the wind speeds and wind direction. the reason why, the second of this month we've been in the below average temperatures, strong northwest winds coming in off the ocean which this time of year will cause up welling off the coast for you. got the winds, 10 to 20 miles

per hour coming in from the northwest. what that helps to do is up well the cooler ocean water from below but drops the coastal sea surface temperatures in the low to mid 50s. part of the air conditioning off to the west and the long shore drift pattern, california current that moves north to south down the coast, this has been a very persistent pattern since the 2nd of the month. a lot of things have been coming up onshore. as you saw down the southern california, the oil spill near santa barbara, some of that possibly could be getting into the beaches further south of that spill area. northwest winds around the bay area. also keep temperatures along the coast fairly cool. may bring in low clouds like we're seeing right now. low to mid 50s. low clouds through mid morning for inland valleys and clearing out the sunshine as a slight wa warm-up starts today. high clouds passing on by. upper level disturbance will ride on through for the afternoon which will give us partly cloudy skies. out toward the tri-valley and areas south of san jose, slight warmup today. highs in the mid 70s around san jose. san francisco, upper 50s to low

60s. we do have a giants game after 7:00. classic at&t park weather. numbers there in the 50s after 7:00. out towards the north bay, south winds not allowing temperatures to warm up a whole lot today. we'll see the pattern weaken slightly by saturday which will allow temperatures to come up a bit more. notice concord, livermore, pleasanton, close to 80 degrees today. we'll see those temperatures climbing up probably through about saturday for the south bay. just a slight warmup in san francisco. mid 60s as we start the weekend off. and 70s to 80s around the north bay. and sunday, a few showers coming in with more clouds. and for the tri-valley highs in the 80s to start the weekend. cooling for sunday as we see not just clouds possibly coming in by late saturday but the upper level system moving on the north coast could bring a few showers. it's also going to re-enforce cooling temperatures again early next week. just as quickly as things warm up notice san jose dropping down to 72 degrees again by monday. now towards livermore, warm start to the weekend.

with more rain on the horizon. oklahoma city experiencing its record. at least 21 people have died from this week's storms in texas and oklahoma. within the past 15 minutes we've just learned that stanford university among the 19 labs that got live anthrax samples. states that got the anthrax. >> "today in the bay's" kris sanchez joins us now with the latest developments. kris? >> like you said, that stanford lab is one of 19 labs that got that live virus. we can tell you this morning that as of now u.s. military officials say that no one is showing any signs of symptoms of anthrax poisoning and yet the commander of the military site responsible says they are trying to find out how this happened that there is no danger to the public. believing that requires trust. dougway proving ground in utah developed that strain and killed the virus to render it safe for researchers like the ones at stanford. but two weeks ago maryland lab

workers discovered it was still live. the samples were shipped via fedex to military and commercial labs in nine states, plus south korea. and because it was supposed to be dead virus the researchers who were working with it may not have been wearing much more than the simple face masks your dentists use because it wasn't a risk. they were supposed to be enclosed fully in protective gear if it were a live virus. this morning the commander in charge of offering assurance as members of the research community are outraged. >> also no known risk to the general public and no suspected or confirmed cases of anthrax infection at the potentially exposed lab workers in the states. >> these were supposed to be killed anthrax spores. and you would like that assurance before the material is sent. >> so again, 19 labs and that includes stanford university's lab have those samples. the centers for disease control

and prevention are trying to round up the samples. they will be transferred to cdc laboratories for further testing. believe it or not the cdc has done this as well. in addition to this accidental shipping, in june of last year a cdc lab sent live anthrax, potentially exposing 80 people. the cdc head was fired over that one. and in 2004 a maryland lab sent live anthrax to a children's hospital here in california. we are reaching out to stanford university for comment this morning. we will get that for you later on this morning. by the way, that live anthrax was shipped just like the stuff you buy online, via fedex, no warning label, no special packaging, and the krrkscdc is collecting samples for testing. they're going to be shipped fedex as well. >> thank you very much. 6:33. the fbi is stepping in to investigate a surgical instrument that may have spread cancer in women. the device made by johnson & johnson was taken out of service

last year. it's called surgeons use it during hysterectomies to crush tissue so the tissue could easily be removed from the body. for women with certain underlying health conditions the fda says the device also spreads cancer cells into the abdomen and pelvis. the fbi is looking into what johnson & johnson knew about the potential problems and when. clearing the air now, rosier outlook on what's going on outside. microclimate forecast at 6:34. yes, heavy presence of fog so far this morning. but you know what, conditions are going to change. especially as we look forward to the weekend, rob, looking for warmer temperatures. >> yeah, we're watching temperatures for a place like san jose or the tri-valley beginning to climb up a little bit today and then we think quite a bit more by the time we get into friday and saturday. but outside right now, low clouds and misty skies again. san francisco to oakland right now you saw the view earlier there in san francisco. 56, san jose. mostly cloudy start to the morning. there's the view again in san

francisco. 53 degrees. bottoms of the low clouds, low enough to touch the tops of those buildings around downtown. notice the drizzle here not at oracle arena. unless a splash brothers left overs from last night. at the airport we do have drizzle. enough to wet the pavement there on some of the runways. oakland airport this morning. we got low clouds for the morning. and then clearing skies for the afternoon with a few high clouds passing by during the day. that will filter the sun at times. not much warming today around san francisco or the coast. the tri-valley and parts of the south by a will begin to see temperatures climbing up more. so low to mid 70s closer to san jose today. we will see highs near 60 in san francisco. into the north bay, highs in the low 70s around santa rosa. pleasanton and livermore close to 80 degrees. 66 in oakland and out in the evening around the east bay, 07 yankees taking on the as. cooling to the 50s in oakland. as we approach the start of the weekend, temperatures will climb up. san francisco, mid 60s by

saturday. look at the south bay. upper 70s to low 80s there. by friday and saturday. more clouds and cooling in the sunday. in fact, for the north bay, slight chance of showers by sunday. before then, upper 70s to near 80 on saturday. tri-valley temperatures climbing close to the mid oughtitys by saturday. mike? >> all right, rob, we're going to turn our attention toward the camera over in emeryville where i've turned its attention to the maze. you see the slowing, the upper right side. you see the curve. heading away from the right. berkeley curve. that's where slowing starts. also across the center of your screen. i don't know if you can make it up. west 580. let's show you on the maps. only slow section on the approach to the bay bridge toll plaza. light volume. east shore freeway, speed. same thing on the left side of your screen. 101 and san rafael and the city. as we widen out the shot you see the pattern typical for the flow. we're looking at a slowdown for the tri-valley and east bay hayward and union city for the nimi nimitz. lighter volume. we are starting to see the

traffic shift. typical at the rest of the bay. south bay as well. they've already hit many colleges and schools as well around the bay. going to start getting a lighter flow of traffic. folks are shifting today a little bit later. as we look at the foster city side of the bridge showing you the san mateo bridge with the westbound traffic coming over the east bay. start to see that build on the peninsula. it won be a major problem. sam, you don't have the kids and so we'll let you know that school age kids, we've got bring them early before 8:00 to school at qu78, but as summer camps kick in people shift to a later start and get into the office a a little later. >> sometimes i do wish we had them so they could wake me up. >> hey, we could enjoy a weekend away. life with the triplets. >> bring the triplets on. >> new reality series with sam brock, "life with triplets." still ahead, the typical grocery item that led to an ent counter between a man and a black widow. and swipe less for stds?

"today in the bay's" bob redell live at santa clara county jail's main jail this morning where mcdonald waungd out just a few hours ago. now he's in trouble for violating a restraining order. >> reporter: laura and sam, ray mcdonald's lawyer tells us his client was never served that restraining order ordering him to stay away from a woman who lives in an apartment that mcdonald owns. here's what mcdonald had to say to us as he left the county jail last night. >> were you at the apartment earlier today? >> man. why don't y'all go home or something. >> mcdonald not address that issue to us. not interested in doing so. that was his second time in jail this week group might recall on monday deputies arrested him for allegedly assaulting a woman who happened to have a baby in her arms a t the time at the apartment that he owns. that's when the judge issued the restraining order against mcdonald.
